En contrepartie du consentement de ma formulaire et la permission de participer au Banque Scotia 21k et au 5k de Montréal le 29 avril 2012, ainsi qu’à tout autre événement où j’engagerai ma participation (ci-après l’événement), en mon nom, nom de mes proches, héritiers, ayants cause, ayants droit et assureurs, et tiens à dégager, à tenir indemne et à couvert toute poursuite contre la Ville de Montréal et le Parc Jean Drapeau de Montréal, Athlétisme Canada, la Fédération québécoise d’athlétisme, Banque Scotia, Canada Running Series Inc., Boutique Endurance, ASICS Canada, ainsi que leurs filiales, leurs administrateurs, leurs directeurs, leurs actionnaires, les membres de leur personnel, leurs représentants et agents, y compris les ayants droit, successeurs et assureurs de ceux-ci, de même que tout consultant, commanditaire, agence de publicité, propriétaire ou locateur des lieux liés à l’Événement (ci-après nommés les partis dégagés de toute responsabilité), advenant un dommage, une blessure corporelle, une incapacité, voire même la mort, une perte ou dommage matériel, découlant ou non d’une négligence d’un ou des partis dégagés de toute responsabilité, peu importe si cette négligence a été démontrée ou non, et ce, dans toute la mesure autorisée par la loi. J’accepte de recevoir périodiquement par la poste ou par courrier électronique des envois de Canada Running Series Inc. uniquement.

In consideration of the acceptance of my application and the permission to participate as an entrant or competitor in the Banque Scotia 21k de Montreal and 5k on April 29th, 2012, and any other pre and post-race activities, I for myself, my heirs, executors, administrators, successors, and assigns HEREBY RELEASE, WAIVE and FOREVER DISCHARGE the Ville de Montreal and Parc Jean-Drapeau, Athletics Canada, Fédération québecoise d’athlétisme, Canada Running Series Inc. (1399662 Ontario Inc.), ASICS CANADA, Boutique Endurance and all other associations, sanctioning bodies and sponsoring companies, and elected and appointed officials, successors and assigns, of AND FROM claims, demands, damages, costs, expenses, actions and causes of action, whether in law or equity, in respect of death, injury, loss or damage to my person or property HOWSOEVER CAUSED, arising or to arise by reason of my participation in the said event, whether as a spectator, participant, competitor or otherwise, whether prior to, during or subsequent to the event AND NOTWITHSTANDING that same may have contributed to or occasioned by the negligence of the aforesaid. I hereby agree to periodic mailings, both electronic and physical from Canada Running Series Inc. and to allow the use of any photographs taken of me in the run by the organizers for future event promotional purposes without compensation. Such photos not to be used for any other commercial or re-sale purposes. I FURTHER HEREBY UNDERTAKE TO HOLD AND SAFE HARMLESS AND AGREE TO INDEMNIFY all of the aforesaid from and against any and all liability incurred by any or all of them arising as a result of, or in any way connected with, my participation in the said event. BY SUBMITTING THIS ENTRY, I ACKNOWLEDGE HAVING READ, UNDERSTOOD, AND AGREE TO THE ABOVE RELEASE, WAIVER AND INDEMNITY. I WARRANT that I am physically fit to participate in this event.
