RENONCIATION / WAIVER

DÉGAGEMENT DE RESPONSABILITÉ, RENONCIATION À TOUT RECOURS, ACCEPTATION DES RISQUES ET CONVENTION D'INDEMNISATION EN SIGNANT LE PRÉSENT DOCUMENT, VOUS RENONCEZ À CERTAINS DROITS, Y COMPRIS LE DROIT D'INTENTER DES POURSUITES À LIRE ATTENTIVEMENT

En contrepartie de mon droit de participer à l'une des activités organisées par The Canadian Adventure Racing Association et XTRAIL ASICS, je déclare et conviens par les présentes de ce qui suit :

1. Je connais bien et j'accepte les risques de blessures graves et de décès inhérents à ma participation à toute activité récréative organisée, particulièrement toute activité de trekking, course de montage, traverse de ruisseaux en sentiers balisés, et toute activité similaire, organisée dans le cadre du programme d'activités de The Canadian Adventure Racing Association et du XTRAIL ASICS.
2. Je me suis assuré(e), et je crois, que je possède les capacités mentales, physiques et affectives requises pour participer à ce programme et que mon équipement, s'il y a lieu, est propre à l'usage prévu par ce programme d'activités.
3. Il est entendu que toutes les règles de participation doivent être respectées et que je suis entièrement responsable de ma propre sécurité en tout temps.
4. Je me retirerai immédiatement de l'activité, et en informerai le responsable le plus près, si j'observe ou perçois à quelque moment des risques inhabituels ou des conditions dangereuses, si j'estime que mes capacités physiques, mentales ou affectives sont altérées, si mon équipement s'est détérioré, ou encore si je suis allé(e) au-delà de mes capacités, au point que je doive mettre fin à ma participation.

JE CONVIENS, EN MON NOM PERSONNEL ET AU NOM DE MES HÉRITIERS, AYANTS DROIT, REPRÉSENTANTS PERSONNELS ET PROCHES PARENTS, QUE MA SIGNATURE DU PRÉSENT DOCUMENT CONFIRME CE QUI SUIT :

1. J'ACCEPTE SANS RÉSERVE TOUS LES RISQUES liés à ma participation à toute activité de The Canadian Adventure Racing Association et du XTRAIL ASICS, même s'ils découlent de la négligence ou faute lourde de tous les propriétaires de terrains (Ski Mont Sutton Inc., Parc d'environnement naturel de Sutton, JH Boulanger, Ville de Sutton,Sentiers de l'estrie et autres propriétaires de terrains), commanditaires, organisateurs, responsables du lieu des activités, ou de quelque personne qui y est associée (bénévoles) ou y participe à quelque titre que ce soit, y compris toute complication ou aggravation de mes blessures attribuable à des opérations ou actes de sauvetage exécutés avec négligence ; j'accepte en outre les risques associés au lieu même des activités, ainsi que les risques de transport à destination et en provenance du lieu des activités.
2. JE DÉGAGE ENTIÈREMENT DE TOUTE RESPONSABILITÉ les propriétaires de terrains (sus-mentionnés au point 1) (Ski Mont Sutton Inc. Parc d'environnement naturel de Sutton, JH Boulanger, Ville de Sutton,Sentiers de l'estrie et autres propriétaires de terrains), tous les commandaitaires et partenaires, ainsi que leurs administrateurs, dirigeants, employés, entraîneurs, directeurs, sous-traitants, mandataires ou représentants, publicitaires, bénévoles et toute autre personne participant aux activités à quelque titre que ce soit (collectivement désignés les « renonciataires ») ET RENONCE DÉFINITIVEMENT À TOUT DROIT D'INDEMNISATION dont je peux ou pourrais me prévaloir contre eux, à l'égard de quelque perte, dommage, blessure ou frais que je pourrais subir par suite de mon utilisation des installations de l'activité, par ma présence ou ma participation à toute activité, en tout ou en partie, des renonciataires, quelle qu'en soit la cause, Y COMPRIS LA NÉGLIGENCE, LA FAUTE LOURDE, LA VIOLATION DE CONTRAT, LE MANQUEMENT À TOUT DEVOIR DE DILIGENCE, LÉGAL OU AUTRE, Y COMPRIS LE DEVOIR DE DILIGENCE QUI INCOMBE AUX RENONCIATAIRES EN VERTU DES LOIS PERTINENTES.
3. JE CONVIENS DE NE PAS INTENTER DE POURSUITE CONTRE LES RENONCIATAIRES pour quelque perte, blessure, coût ou dommage, de quelque forme et quelque type que ce soit, attribuables directement ou indirectement à ma participation à l'une quelconque des activités du programme ou des activités connexes.
4. JE CONVIENS D'INDEMNISER LES RENONCIATAIRES, et chacun d'eux, de tous frais judiciaires, frais juridiques, responsabilité, dommages, dépens ou coûts, de quelque forme et quelque type que ce soit, qu'ils pourraient devoir engager en raison de toute réclamation déposée contre eux, ou contre l'un d'entre eux, que la réclamation soit fondée sur la négligence ou la faute lourde des renonciataires ou non.
5. Je conviens que le présent document est régi par les lois et les tribunaux de la province de Québec.

J'AI LU ET COMPRIS LE PRÉSENT DOCUMENT ET JE RECONNAIS QU'EN Y APPOSANT MA SIGNATURE, JE RENONCE À CERTAINS DROITS IMPORTANTS QUE JE POURRAIS LÉGALEMENT AVOIR, OU QUE MES HÉRITIERS, PROCHES, LIQUIDATEURS DE SUCCESSIONS, AYANTS DROIT ET ADMINISTRATEURS POURRAIENT LÉGALEMENT AVOIR, CONTRE LES RENONCIATAIRES. JE SIGNE LE PRÉSENT DOCUMENT DE MON PLEIN GRÉ, SANS CONTRAINTE RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY!

In consideration for allowing me to participate in any or all events and related activities of The Canadian Adventure Racing Association and XTRAIL ASICS , I hereby warrant and agree that:

1. I am familiar with and accept that there is always the risk of serious injury and death resulting from participation in any organized recreational activity particularly those involving (off-road running) and like activities offered as part of the programme of The Canadian Adventure Racing Association and XTRAIL ASICS.
2. I have satisfied myself, and believe, that I am physically, emotionally and mentally able to participate in this programme, and that my equipment, if applicable, is appropriate for use in this programme; and
3. I understand that all applicable rules for participation must be followed and that at all times the sole responsibility for personal safety remains with me; and
4. I will immediately remove myself from participation, and notify the nearest official, if at any time I sense or observe any unusual hazard or unsafe condition or if I feel that I have experienced any deterioration in my physical, emotional or mental fitness, or that of my equipment, or exceeded my comfort level, for continued participation in any event or related activity. I UNDERSTAND AND AGREE, ON BEHALF OF MYSELF, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN THAT MY EXECUTION OF THIS DOCUMENT CONSTITUTES:

1. AN UNQUALIFIED ASSUMPTION BY ME OF ALL RISKS associated with my participation in the any or all of the events and activities of The Canadian Adventure Racing Association and XTRAIL ASICS even if arising from the negligence or gross negligence, including any compounding or aggravation of injuries caused by negligent rescue operations or procedures, of Ski MONT SUTTON Inc., Parc d'environnement naturel de Sutton (PENS), JH Boulanger, Sentiers de l'estrie and others landowners, any event organizer, event venue and any and all persons associated therewith or participating therein in any capacity; or in transportation to and from such events and activities, and
2. A FULL AND FINAL RELEASE AND WAIVER OF LIABILITY AND ALL CLAIMS that I have, or may in the future have, against the XTRAIL ASICS, Ski MONT SUTTON Inc., Parc d'environnement naturel de Sutton (PENS) and JH Boulanger, Sentiers de l'estrie and others landowners, all associated sponsors and partners, and their respective directors, officers, employees, coaches, leaders, contractors, agents and representatives, advertisers, volunteers, others participating in any capacity, (all of whom are collectively referred to as 'the Releasees') from any and all liability for any loss, damage, injury or expense that I may suffer as a result of my use of or my presence at event facilities, or my participation in any part of, or presence at, any or all of the events and related activities of the Releasees due to any cause whatsoever, INCLUDING NEGLIGENCE, GROSS NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE RELEVANT OCCUPIERS LIABILITY ACT ON THE PART OF THE RELEASEES.
3. AN AGREEMENT NOT TO SUE THE RELEASEES for any loss, injury, costs or damages of any form or type, howsoever caused or arising, and whether directly or indirectly, from my participation in any aspect of the said events and related activities; and
4. AN AGREEMENT TO INDEMNIFY, and to SAVE and HOLD HARMLESS the RELEASEES, and each of them, from any litigation expense, legal fees, liability, damage, award or cost, of any form or type whatsoever, they may incur due to any claim made against them or any one of them whether the claim is based on the negligence or the gross negligence of the Releasees or otherwise.
5. an agreement that this document be governed by the laws, and in the courts of the Province of Québec.
6. An agreement to release the organisation for any uses of any pictures taking during the event including myself. I give my consent, without any compensation, for using pictures of myself for any promotional uses (website, promotional articles, etc')
